§ 1.9. Conformance with other documents and conflicting provisions.

  • 1.9.1.

    Conformance. .....In addition to the regulations found in this ordinance, all land development activity within the county shall comply with the county comprehensive plan, county zoning ordinance, county erosion and sediment control ordinance, master water and sewer ordinance, Chesapeake Bay Preservation Area Ordinance, and all other applicable local, commonwealth, or federal ordinances and regulations.

    1.9.2.

    Conflict.

    A.

    Conflict with state or federal regulations. .....If the provisions of this ordinance are inconsistent with those of the state or federal government, the more restrictive provision governs. Regardless of any other provision of this ordinance, no land may be developed or used, and no structure may be erected or maintained, in violation of any state or federal regulation.

    B.

    Conflict with local regulations. .....If the provisions of this ordinance are inconsistent with one another, or if they conflict with provisions found in other adopted ordinances or regulations of the county, the more restrictive provision governs.

    1.9.3.

    Private contracts. .....This ordinance bears no relation to any private contract, easement, covenant, agreement or restriction, nor is the responsibility of enforcing such private easement, covenant, agreement or restriction implied herein to any public official. When this ordinance calls for more restrictive standards than are required by private contracts, the provisions of this ordinance shall control. No public official or county staff shall be responsible for enforcing a private contract, covenant, agreement, or restriction of any type.
