§ 3000. Areas of applicability.

  • (a)

    The Chesapeake Bay Preservation Area (CBPA) Ordinance shall apply to all lands within the Chesapeake Bay drainage basin. The limits of this area are generally shown on the Chesapeake Bay Preservation Area maps adopted by the board of supervisors, which together with all explanatory matter thereon, are adopted as a part of this ordinance. This information may be supplemented by digital mapping resources in the course of administering the provisions of this ordinance.

    (b)

    The Chesapeake Bay Preservation Area shall be divided into two areas consisting of the following:

    1.

    The Resource Protection Area (RPA), .....which shall include:

    a.

    Tidal wetlands;

    b.

    Nontidal wetlands connected by surface flow and contiguous to tidal wetlands or water bodies with perennial flow;

    c.

    Tidal shores;

    d.

    Water bodies with perennial flow, including streams, rivers, lakes and ponds;

    e.

    Other lands as may be designated by the Board of Supervisors and shown on the CBPA maps; and

    f.

    A vegetated buffer area not less than 100 feet in width located adjacent to, landward of, and on both sides of the resources listed in subsections a. through e. above.

    2.

    The Resource Management Area (RMA) .....shall consist of all areas within the Chesapeake Bay watershed. (8-21-06.)
