§ 6008. Enforcement, violations and penalties.

    Enforcement. .....The zoning administrator, or authorized designee, holds the primary responsibility for administering the septic pump-out program. The zoning administrator shall seek criminal or civil enforcement for any provision of this program and take any action on behalf of the county to prevent or abate any violation or potential violation of this program.

    The zoning administrator, upon written request of an interested person whose property may be affected, shall render a decision, based on the facts presented, as to the applicability of this ordinance to particular situations that may arise under the septic pump-out program. See subsection 6007.E. regarding complaints and appeals.

    B.

    Penalties. .....Violators shall, upon finding by an appropriate circuit court, be assessed a penalty up to five thousand dollars ($5,000.00) for each day of violation.

    As an alternative to a court-ordered penalty, violators may be offered the option of a onetime payment of civil charges for each violation in specific sums, not to exceed ten thousand dollars ($10,000.00) for each violation, as determined by the Isle of Wight County Board of Supervisors.
