§ 4.1-9. Periodic review.

(a)

Periodic evaluation, review and modification. .....The field of requirements and conditions applicable to the services authorized by this ordinance are rapidly changing. Therefore, in order to provide for a maximum degree of flexibility in this ordinance, and to help achieve a continued advanced and modern system, the following evaluation provision will apply:

(1)

The county or cable operator may require evaluation sessions at any time during the term of this ordinance, provided, however, unless otherwise agreed to there shall not be more than one evaluation session during any three years and that the first such evaluation session will occur no sooner that three years after the effective date of this ordinance.

(2)

As a result of a periodic review, the county or cable operator may determine that a change in the terms of this ordinance is required. The county and cable operator will in good faith, review and negotiate the terms of the change and any amendment required to this ordinance. Based on this review, and upon adoption of such a change or new requirement through a mutually acceptable ordinance, the change will become effective. (Ord. No. 2011-22-C, 11-15-11.)
