§ 1.11. Transitional provisions.

    Violations continue. .....Any violation of previous subdivision ordinances will continue to be a violation under this ordinance and be subject to penalties and enforcement under this ordinance unless the use, development, or activity complies, in its entirety, with the provisions of this ordinance.

    1.11.2.

    Violations in progress. .....The prosecution of violations which occurred under previous ordinances shall continue until resolved.

    1.11.3.

    Effect of this ordinance on approved plans and on completed applications.

    A.

    Approved plats and permits and completed applications.

    The requirements of this ordinance shall not apply to lots shown on a preliminary subdivision plat approved by the board of supervisors as of the effective date of this ordinance, provided the subdivider submits a final subdivision plat for all or a portion of the property within one (1) year of such approval and thereafter diligently pursues approval of the final subdivision plat.

    2.

    Applications for such approvals may be approved if in compliance with the ordinance in effect at the time of submission. The expiration and continued validity of any approved permits, plans, or plats shall be governed by the ordinance in effect at the time of submission. The continued validity of development plans on incomplete subdivision improvements shall be determined pursuant to incomplete developments, below.

    B.

    Incomplete developments. .....The requirements of this ordinance shall not apply to lots shown on a preliminary subdivision plat pending approval as of the effective date of this ordinance, provided the following conditions are met:

    1.

    The requirements of the former Isle of Wight County Zoning Ordinance and amendments thereof shall be met.

    2.

    The preliminary subdivision plat is approved by the board of supervisors or the subdivision agent, as may be required, within ninety (90) days from the effective date of this ordinance. This time period may be extended by the board of supervisors upon written request.

    3.

    A final subdivision plat is submitted for all or a portion of the property within one (1) year of such approval and thereafter the subdivider diligently pursues approval of the final subdivision plat.
