§ 3.1. Review and decision-making bodies.

    Board of supervisors.

    A.

    Final action. .....The board of supervisors shall hear and take final action on the following ordinance procedures:

    1.

    Appeal of administrative decision (section 3.2.12);

    2.

    Waiver (section 3.2.10); and

    3.

    Amendments to the subdivision ordinance (section 3.2.11).

    3.1.2.

    Planning commission.

    A.

    Review and recommendation. .....The planning commission shall review and make recommendations on the following ordinance procedures:

    1.

    Waiver (section 3.2.10); and

    2.

    Amendments to the subdivision ordinance (section 3.2.11).

    3.1.3.

    Subdivision agent. .....A subdivision agent shall be appointed by the board of supervisors to administer this ordinance. The subdivision agent shall perform his/her duties in accordance with this ordinance and applicable state and federal regulations. The subdivision agent may call for opinions or recommendations, either verbal or written, from other departments or agencies in considering details of any application.

    A.

    Review and recommendation. .....The subdivision agent shall review and make recommendations on the following ordinance procedures:

    1.

    Waiver (section 3.2.10); and

    2.

    Amendments to the subdivision ordinance (section 3.2.11).

    B.

    Final action. .....The subdivision agent shall hear and take final action on the following ordinance procedures:

    1.

    Designation as major or minor subdivision (section 3.2.6.D);

    2.

    Granting an exception from subdivision requirements (section 3.2.3.B);

    3.

    Family member subdivision - Approval (section 3.2.4);

    4.

    Conceptual plan review (section 3.2.5);

    5.

    Minor subdivision - Preliminary plat approval (section 3.2.6.E);

    6.

    Minor subdivision - Minor revision(s) of approved preliminary plat (section 3.2.6.J);

    7.

    Major subdivision - Preliminary plat approval (section 3.2.6.E);

    8.

    Major subdivision - Minor modification of approved preliminary plat (section 3.2.6.J);

    9.

    Construction plan approval (section 3.2.7.D);

    10.

    Minor subdivision - Final plat approval (section 3.2.8);

    11.

    Major subdivision - Final plat approval (section 3.2.8);

    12.

    Plat vacation (section 3.2.9.C); and

    13.

    Cluster/sliding scale "by-right" approval.

    C.

    Additional authority. .....In addition to the regulations herein contained for the platting of subdivisions, the subdivision agent may establish reasonable additional administrative procedures deemed necessary for the proper administration of this ordinance.

    D.

    Delegation of authority. .....Unless specifically prohibited, the subdivision agent may delegate review and decision making authority to the deputy subdivision agent or other Isle of Wight County staff with training and experience in the review and administration of subdivision-related applications. However, the subdivision Agent shall have ultimate responsibility for any action made by a delegate in the interpretation and enforcement of this ordinance.

    3.1.4.

    Director of general services.

    A.

    Review and recommendation. .....The director of general services shall review and make recommendations on the following ordinance procedures in conjunction with the engineering division:

    1.

    Review of public utility systems design;

    2.

    Coordination of review with other state agencies for improvements requiring state approval unless otherwise specified by the director of general services;

    3.

    Erosion and sediment control plan review; and

    4.

    Stormwater management plan review.

    3.1.5.

    Other review entities. .....A variety of other commenting or advisory bodies approved by the board of supervisors may participate in development review under this ordinance, including, but not limited to:

    1.

    The Isle of Wight County Health Officer;

    2.

    The Virginia Department of Transportation (VDOT);

    3.

    The Virginia Department of Environmental Quality (VDEQ);

    4.

    The Virginia Marine Resources Commission (VMRC);

    5.

    The Virginia Department of Health, Office of Drinking Water;

    6.

    The Virginia Department of Conservation and Recreation (VDCR);

    7.

    U.S. Army of Corps of Engineers (USACOE); and

    8.

    Hampton Roads Sanitation District (HRSD). (8-8-19.)
